General Terms and Conditions (GTC) for the holiday apartment HAPPY DAYS Fehmarn
§1 Conclusion of the Contract By booking the holiday apartment HAPPY DAYS Fehmarn, the guest makes a binding offer to the landlord to enter into a rental agreement. The contract is concluded upon confirmation by the landlord. Confirmation may be provided in writing, by email, or by telephone.
§2 Payment and Prices The guest agrees to pay the agreed rental price for the booked period. The total amount is due within 10 days of receiving the booking confirmation. In the case of short-notice bookings (less than 5 days before arrival), the full amount is payable immediately.
§3 Arrival and Departure The holiday apartment is available from 3:00 p.m. on the day of arrival. On the day of departure, the apartment must be vacated by 10:00 a.m. at the latest in a broom-clean condition. Different times can be arranged individually upon request.
§4 Cancellation and Withdrawal The guest may cancel the rental agreement at any time before the start of the stay. Cancellations must be made in writing or by email. The cancellation conditions of the respective booking platform used apply. For direct bookings, the following cancellation fees apply: Cancellation up to 14 days before arrival: free of charge Cancellation from 13 to 8 days before arrival: 50% of the rental price Cancellation from 7 days before arrival or in the event of no-show: 90% of the rental price The landlord will make every effort to re-let the apartment. If successful, only a handling fee of €150 will be charged.
§5 Use of the Apartment The apartment may only be used by the number of people stated in the booking confirmation. Additional persons must be requested in advance and may be added to the rental agreement for an additional fee per person. Pets are not allowed. The guest agrees to treat the apartment with care and to report any damage or defects to the landlord without delay.
§6 Liability and Damages The guest is liable for all damage caused by themselves or their companions during the stay. This includes, in particular, damage to furniture, furnishings, or the apartment itself. Detected damage will be documented by the landlord and invoiced to the guest. The amount of compensation is based on the cost of repair or replacement. The landlord is not liable for the loss or damage of guests' belongings unless caused by gross negligence or willful misconduct on the part of the landlord.
§7 Cleaning and Final Cleaning The guest agrees to keep the apartment clean during the stay. The cost of final cleaning is included in the rental price and is payable with the advance payment. In the event of excessive dirt or soiling beyond normal use, the landlord reserves the right to charge additional cleaning fees afterwards.
§8 Withdrawal by the Landlord The landlord is entitled to withdraw from the contract if unforeseeable events (e.g. natural disasters, official orders) make the rental impossible. In such cases, any rental payments already made will be fully refunded. Further claims are excluded.
§9 Data Protection The guest’s personal data will be used exclusively for handling the booking and fulfilling the rental agreement. Data will only be passed on to third parties if necessary for the execution of the contract.
§10 House Rules The house rules available in the apartment are part of the rental agreement and must be observed by the guest. Disturbances and nuisances to neighbors must be avoided, especially during the quiet hours from 10:00 p.m. to 7:00 a.m. §11 Severability Clause Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the applicable statutory regulation.
§12 Place of Jurisdiction The place of jurisdiction for all disputes arising from this contract is Uelzen, Germany.
